1. Introduction
1.1 Agreement
Welcome to Aussie Game Hosts (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our services, including the renting of game servers and related hosting solutions (“Services”). By purchasing, subscribing to, or using our Services, you agree to be bound by these Terms.
1.2 Amendments
We reserve the right to modify or update these Terms at any time. Any changes will be effective upon posting the revised Terms on our website. You are responsible for reviewing these Terms periodically. Continued use of our Services after such changes have been posted constitutes your acceptance of the revised Terms.
1.3 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Competition and Consumer Act 2010 (Cth) or relevant legislation that cannot be lawfully excluded or limited.
2. Service Level Agreement (SLA)
2.1 Uptime Commitment
We strive to maintain a 100% uptime. However, we guarantee a 99% uptime per calendar month for our Services to allow for maintenance and unforeseen disruptions.
2.2 Remedies for Downtime
If we fail to meet the 99% uptime guarantee, affected customers will be eligible for a pro-rated service credit applied to the subsequent billing cycle. This credit is the sole and exclusive remedy for any downtime or disruption to the Services.
3. Duration of Contract & Renewals
3.1 Billing Cycles
You may purchase our Services on a monthly, quarterly, semi-annual, or annual basis ("Billing Cycle"). For example, if you sign up on 15 April for a monthly plan, your service will expire on 15 May unless renewed.
3.2 Expiry & Suspension
- We will issue a renewal invoice at least 7 days prior to the service expiration date.
- If the renewal invoice is not paid by the due date, your Services may be suspended.
- If no payment is received within 15 days post-suspension, we reserve the right to terminate your Services and delete all associated data.
3.3 Termination by Us
We reserve the right to terminate your Services at any time if you are found to be in breach of these Terms or any other policy referenced herein.
4. Payment Methods
4.1 PayPal Gateway
We accept payments via PayPal, which allows you to use credit cards, debit cards, or other PayPal-supported methods. We do not store your financial details on our servers.
4.2 Bank Transfers
Direct bank transfers may be accepted by prior arrangement. You are responsible for using the correct reference details to ensure your payment is credited accurately. Please notify us once a transfer is made, for manual approval.
4.3 Currency & Taxes
All fees are displayed in Australian Dollars (AUD) unless otherwise specified. You are responsible for any taxes or duties applicable to your purchases.
5. Billing Disputes & Chargebacks
5.1 Disputes
If you initiate a dispute or chargeback (eg., through PayPal or your bank), we may immediately suspend or restrict access to your Services until the dispute is resolved.
5.2 Resolution
If we determine that the dispute or chargeback is invalid, you may be responsible for any associated fees or costs incurred by us. Repeated or unjustified chargebacks may result in the permanent termination of your account and Services.
6. Refunds & Cancellations
6.1 Money-Back Guarantee
We offer a 7-day money-back guarantee for new orders. If you are not satisfied for any reason, you may request a refund within 7 days of purchase.
6.2 Refund Process
- All refund requests must be submitted through our designated support ticketing channels.
- Refunds will only be processed to the original payment method or account used for the transaction.
- Credits, promotional balances, or free credits cannot be redeemed for cash or transferred to other accounts.
7. Support & Self-Managed Services
7.1 Level of Support
Our support team aims to respond to queries promptly and provide guidance within the scope of our Services.
7.2 Self-Managed Components
Unless otherwise stated, all Services are self-managed. Not limited to the following, we are not obliged to install, configure, or troubleshoot:
- Plugins or mods
- Configuration files
- Models or materials
- Maps
7.3 Staff Interactions
We value respectful communication. We reserve the right to suspend or terminate your Services if you engage in abusive or threatening behaviour towards our staff.
8. Malicious Attacks
8.1 Zero Tolerance
We do not tolerate any attempts to disrupt our network, including but not limited to Distributed Denial of Service (DDoS) or Denial of Service (DoS) attacks.
8.2 Consequences
If we suspect any malicious activity originating from your account, we may suspend or terminate the Services immediately, without prior notice or refund.
9. Resource Usage
9.1 Fair Usage Policy
While we provide resources to run game servers effectively, usage must be within reasonable bounds. We may monitor CPU, RAM, disk space, bandwidth, and other resource usage to ensure a fair, stable environment for all clients.
9.2 Excessive Usage
If your usage is deemed excessive in comparison to the average usage for similar Services (as determined by us), we may request that you reduce your consumption or upgrade your plan. Continued excessive usage may result in temporary suspension or termination.
9.3 Disclaimer
We may allocate or manage resources in a manner that maximises server performance and availability. However, specific resource thresholds are not guaranteed unless explicitly stated in your plan details.
10. Server Add-ons & Usage Restrictions
10.1 Add-ons
Any add-ons or extras (e.g., databases) purchased through Aussie Game Hosts are intended solely for use with our hosting Services. You may not use or transfer such add-ons to third-party hosting environments.
10.2 Breach
Unauthorised use of add-ons outside our network will result in immediate suspension or termination of your Services.
11. Registration & Account Security
11.1 Account Credentials
Upon registering for our Services, you will be prompted to create a username and password. You are solely responsible for maintaining the confidentiality and security of these credentials.
11.2 Unauthorised Access
You must notify us immediately of any unauthorised use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to maintain the security of your account.
11.3 Identity Verification
We reserve the right to request proof of identity or other supporting documentation to verify account details in the event of suspected fraud or misuse.
12. Termination
12.1 Termination by You
You may terminate your Services at any time through our client portal or by contacting our support team. No refunds will be provided beyond the 7-day money-back guarantee period unless required by law.
12.2 Termination by Us
We may terminate or suspend your account at our sole discretion if you violate these Terms or any applicable law. We are not liable for any losses or damages arising from such termination.
13. Indemnity
You agree to indemnify, defend, and hold harmless Aussie Game Hosts, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in any way connected with your use of the Services or violation of these Terms.
14. Limitation of Liability
14.1 No Indirect Damages
To the maximum extent permitted by law, we are not liable for any indirect, special, incidental, or consequential damages arising out of or related to the use or inability to use our Services.
14.2 Limitation on Liability
Our total liability for all claims arising out of or relating to the Services is limited to the amount you have paid us in the 12 months preceding the event giving rise to the liability.
14.3 Australian Consumer Law
If the Competition and Consumer Act 2010 (Cth) or any other legislation implies guarantees or obligations that cannot be excluded, our liability is limited, at our option, to the replacement or resupply of Services, or the cost of such replacement or resupply.

If you have any concerns or disputes, please contact our support team. We will do our best to resolve the issue promptly.
15.2 Governing Law & Jurisdiction
These terms are governed by and construed in accordance with the laws of Queensland and the Commonwealth of Australia. You submit to the exclusive jurisdiction of the courts operating in that jurisdiction.
16. General Provisions
16.1 Entire Agreement
These Terms, including any policies referenced herein, constitute the entire agreement between you and Aussie Game Hosts regarding your use of our Services.
16.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.
16.3 Waiver
No waiver of any provision of these Terms by us will be deemed a further or continuing waiver of that provision or any other provision.
16.4 Assignment
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations at any time.
